A bill that aims to prevent rent gouging moved forward in a 43-31 vote in the California State Assembly on Wednesday. The bill was introduced by Assemblyman David Chui.
Assembly Bill 1482, which prevents rent gouging, includes a ten-year sunset provision and exempt new construction of up to ten years old.
The bill states that an owner of residential real property in the state shall not increase the rental rate for that property in an amount that is greater than 5 percent more than the lowest rental rate in effect for the immediately preceding 12 months plus the percentage change in the cost of living.
In March, Chui stated:
“Millions of Californians are just one rent increase away from becoming homeless,” said Assemblymember Chiu. “This legislation will help bring some peace of mind and predictability to renters, allowing them to plan for their future and stay in their homes.”
AB 1482 would institute a statewide anti-rent gouging law to protect against the most egregious rent increases tenants face. The bill would cap annual rent increases to Consumer Price Index (CPI) plus five percent for all rental properties in California that are not subject to local rent control ordinances. New amendments adda ten-year sunset provision to the bill and entirely exempt new rental units that are up to ten years old to be sure that new housing production is not stifled.
Locally, Assemblymember Tim Grayson voted in favor of the bill, Jim Frazier opposed the bill, and Rebecca Bauer-Kahan did not cast a vote.
