RE: For Immediate Release / Fatal Traffic Collision Protocol Investigation
October 31, 2016 at 2:30 AM

During the early morning hours of October 31, Concord Police Officers responded to the area of Kirker Pass Rd. and Kirkwood Dr. for a reported solo vehicle collision. The driver involved in the collision called and advised that he had struck an object in the roadway while driving north on Kirker Pass Rd. The call initially was made to the California Highway Patrol (CHP), was then transferred to the Concord Police Dispatch Center.

This area of Kirker Pass Rd. is a dividing roadway between the City of Concord and the City of Clayton. As Concord Police Officers arrived on scene, a man was found lying in the roadway with injuries consistent with being struck by a motor vehicle. The roadway was closed down and the man was pronounced deceased at the scene.

The Concord Police Traffic Unit responded and took over the investigation. The driver of the vehicle is cooperating and his vehicle shows distinct front end damage consistent with striking an object in the roadway.

As the case developed, Traffic Investigators learned that just prior to this call being received and dispatched, a Clayton Police Officer was on an unrelated call for service connected to the City of Clayton, and he accidentally struck the pedestrian with his patrol car as the man was lying in the middle of the roadway.

Given this information, the Concord Police Department is conducting a joint investigation
alongside the Contra Costa County District Attorney’s Office into the circumstances of this Fatal Traffic Collision. Both the citizen vehicle and the Clayton Police vehicle were towed and are being stored for evidentiary purposes.
