Under prop 47 if the stolen merchandise is under $950.00 value, he will just get a ticket!!!
Even if it’s a armed robbery? I’m not familiar with the law but I would think the fact that he used a weapon in order to escape, with his stolen merchandise would carry a heavier punishment then just a ticket .
I’m fairly certain brandishing a weapon in public is still a felony. He may get a ticket for the shoplifting, but he’ll probably be arrested on the weapon charge. And, since he used a weapon in the shoplifting crime, it may no longer be shoplifting, but armed robbery.
He will most likely be charged with both, armed robbery and shoplifting. That way they will plea him down to just armed robbery. He’ll get 7 months in country jail with a few years probation assuming he has no priors. I would doubt that though…sounds like he was very comfortable doing what he did.
Here’s a great example of Prop 47. Let’s hope it was over $950 because so it is considered a felony. Otherwise this guy can do this repetitively without facing prison time.
So all of you can stop speculating. This is a case of armed robbery, which is still a felony. Why would this article state that he stole merchandise while brandishing a knife. I would hope that Brentqood PD would not put this out as stated. This has nothing to do with prop 47. This could have been a item worth $10 and it is still a felony.
