Press Release: Animal Services Investigating Killing of Livestock and Dogs

The following Press Release has been provided by the Contra Costa County Animal Control Services Department of Contra Costa County. The investigation has still not concluded and they are not releasing any other information at this time.

Contra Costa Animal Services Investigates Incident Involving the Killing of Livestock by Dogs and the Subsequent Killing of the Dogs

Martinez CA, On 29 September 2013, the Contra Costa Animal Services Department was notified of an incident that occurred in Brentwood CA on the 28th of September 2013.

While responding to a call of reported gunshots, Brentwood PD officers were informed of an incident where two domestic dogs were alleged to have killed over 40 chickens and turkeys, on the property of a Brentwood resident. Brentwood PD notified Animal Services immediately. The owner of the poultry told the investigating Animal Services officer that upon finding the dog inside of his chicken enclosure, the dogs approached him aggressively and that he killed both with a garden tool. The livestock owner said that he then incinerated the animals of both the deceased dogs and the deceased poultry.

Well established California law allows for the killing of stray dogs when they are found in the act of killing, wounding, or pursuing livestock or poultry, off of the dog owners property. State law also prohibits cruelly of animals, by causing undue suffering. To date, this investigation remains open as we try to establish whether there were violations of the law.

Maybe someone can explain how Rocky Osborn & Ellen Barkley Guard dogs {Quote “escaped at 6:00 am on Saturday morning”}, and why they would be so fearful as to feel the need to call the Police instead of the animal control?

If Rocky and Ellen were out of town, why where the dogs left outside all night? Did the dogs jump a fence; crawl under; or unlatch the gate? If their property was unsecure then the Guard Dogs should have been on a leash.

It all comes back to the guard dog owners! If you didn’t own dogs, this wouldn’t happen. If your going to own dogs, you have to be responsible!

After two days of refusing to talk to police, his story is out and evolving. 30 dead is now “over 40”, and now he claims to have buried all the birds too, with the dogs. All on his employer’s property. What a considerate employee to have.

A few questions.
What’s the neighbor’s story, and is it changing too? Have any bird carcasses been found in the burial site? Was there a crime scene found in the chicken coop? Chicken blood and bones and feathers were all over the place right? Or has the coop been “Dexterized” with all evidence of fowl-play removed, because that’s just what you want to do as the owner of the “murdered” chickens – remove any evidence vindicating why you “had” to kill the dogs. Hmm… just how long does it take to catch and slaughter 40+ chickens and turkeys? How long to hear it and respond? How long to collect the whole mess and deliver it to your employer’s property? And how long to think up a story that likely can’t be corroborated. Wait, I know that answer – about two days.

First we hear of gunshots. I bet he killed the dogs via gun and burned the dogs to cover up the evidence. The neighbors likely know what is going on and are not talking. I feel very bad for all the families involved.

if the man claims to have taken out two dogs with a shovel all by himself, he is either superman or lying.

from earlier reports I read that the dog chain collar was damaged or broken. He probably had them tied up when he eat them to death.

sometimes dogs escape. the owners went out searching for them. the dogs were not left out to roam the neighborhood. they escaped, and the owners responded appropriately by looking for them.

Dogs get out. Murdering them because they escaped isn’t justifiable. The man who says he was a farmer is not in fact. Someone I know posted a photo of his property which is more like a hoarders make shift coop. He probably has 2 birds. No proof there was 40 and even IF the dogs had collars with tags. Obviously they weren’t strays. He could have tied up the dogs, contacted the owners, and demanded financial compensation. Why didn’t he? Because his story is a LIE LIE LIE from start to finish. To blame the owners and dogs for a cold blooded psycho is pathetic.

I think what Meium rare is meaning is …….What if a child had gotten out and run over cause children will get out if they can as well, (accident they got out),… So dont blame the parents.
However the dogs got out on (accident also) so lets blame the owners, (not that they are saying blame the owners they were simply making a point that they shouldnt be blamed), animals will and do get out when they can no matter how well behaved or trained they are. is what Im sure they meant..
Because a number of people are blaming the owners for them getting lose. The sad fact is any animal if they can find/make a way to get out and explore they will. They were just tying to say sometimes things happen that you cant always predict. So put the blame where it really needs to go on the LIARS in this plot of theirs that is so full of holes it makes me sick:(. The whole of this is getting off where it needs to go the people that killed those lovely dogs need punished no matter what the law says about them being in the right. They were in the wrong by making it so the law took longer to get to the now suppposed truth?

My neighbor’s chickens have jumped the fence and gotten into my yard. I walked to their door and let them know. They came and retrieved them. This happened on two separate occasions. Simple.

Hmmm, let’s see, we have a couple who left their dogs while they went away for the weekend, dogs get loose, dogs are large dogs, dogs don’t stop and tell people if they have vicious tendencies or not, dogs allegedly killed livestock, dogs end up dead at farmers hands. Farmer had the law on his side, owners have law against them (dogs are not allowed to roam around free, you could look it up if you want to). And from that you deduce in your pea brain that the farmer is somehow a vicious murderer of what? I’m guessing the farmer has enough time living in east county to trump all you morons suggesting horrible things about him. Why don’t you just go away Loraine McWhoreter.

I myself am a rancher and unfortunately have had to shoot strays or loose dogs harassing my cattle in the past. I however did the responsible thing and notified law enforcement following my lawful actions, I did not take them to a secondary location and incinerate then bury them. They were TWO large dogs. If they were vicious at least ONE of them would have bitten him and maybe ripped off part of his arm. THAT didn’t happen. Too bad they didn’t. My dad’s dog kept getting out and it was thought that she might be involved in chasing cows, although it was never substantiated. …. My dad was warned…. if she was caught chasing, injuring or killing cows she would be shot on site, no questions asked and no laws broken…… she’s a herding dog, so for her it would have been completely natural. … but for the owner of the cows she was an unknown dog with unknown intentions. ….. the killing of the dogs in Brentwood though was waaaay over the line in my opinion.

Did you see the condition of the property on Channel 2 news tonight? The junk and overgrowth and the tiny pens these alleged poultry were in? The wire and wood is rotted! Could not keep a raccon out of those or fox, coyote or skunk even! Out where we live Farmers keep their livestock in good secure structures not jury rigged junk that’s decaying – they know their investement and do what it takes to protect. The only places we see like that out here are hoarders. There are so many weird looking small structures with little pens – are they even zoned for it? Or all the dead vehicles on the side of road? (which they block off with orange cones) What is really going on out there? It looks like a lot of code enforcement needs to take place along with a real investigation.

On what charge Einstein? Or, are you just making this up as you go along? What law did he break? Farmers have the law on their side when it comes to protecting livestock, and there is no specification as to “how” the dogs are to be killed. Fully within the law as far as the police will see it. Owners however, could be charged with having a dog off leash. What if it had been your dog instead of his birds the two “strays” had been killing? How would you respond then? As a dog owner and lover, I can say that I’ve NEVER had my dogs let loose, not once. When we go away, they either go to the Dog Camp on Morgan Territory, or our Dog Sitter is over three or four times daily, and we don’t have “holes” in our fence. The owners should also be subjected to your ill-conceived kangaroo court sentance you idiot.

That said, mabye a little rock salt could have gone a long way towards ending this without the dogs being killed. Too bad.

He even went out of his way loading the dead dogs up and taking them to his work and taking the time to burry a big hole and find gasoline and burn them and bury them! You are out of your mind. No charge on the dog owners because there is no crime scene where they are at fault. The “crime” of the chicken deaths and how the dogs were murdered was covered up. The law does not say “and once you have shot the dogs, you go ahead and incinerate them if you have access to that equipment”. Interesting name, medium rare, you know in a case where dogs were burned. Probably got your name from being to close to the fire yourself.
My heart breaks for them and the injustice of this case. We had something similar in my area recently, except it was a toddler! The mother said she died one way, but burned her body so no one could investigate how she really died. She got charged with murder, verdict did not come back in her favor, I hope that this dog burner gets the verdict of guilty as well as he his evidence.

From the looks of this guy he doesn’t seem in shape at all. To physically beat two big dogs including a 130lb rottie with a shovel is a big fat lie! He had to of shot them or tied them up. So then he picked up these two dogs himself andput them in a truck to be buried elsewhere? This story is fishy and investigators need to dig deep! Also they had collars on them they were obviously owned dogs not just random aggressive stray dogs on the hunt to kill! Get them out if the coop call the police! If these dogs were so furocious where are his wounds from the dogs attacking him? And really where are the dead chickens and turkeys? Real good livestock owners secure there animals as best as they could. For a dog to just go right on in to a coop he must not have cared that much about his chickens. He really sounds like liar and i really believe he had help and killed these two handsome dogs very cruelly!

And if there dogs got out and were chasing some chickens and were killed in the manner these two dogs were killed they would be very very upset as well! I personally know the owners and can tell you that they had them in a secure place and had someone checking on them several times a day. The owners aren’t saying he didn’t have a right to defend his livestock.. They agree with that but how he did it and what he did after is inhuman. If these dogs killed so many chickens and turkeys, why didn’t he kill the dogs and then call animal control? He could have left everything for them to see knowing the dogs had tags so would know who the owners were and then have them pay to replace the dead birds… But he didn’t do any of that. It is all very suspicious . So while, by law, it is the owners responsibility to keep animals in, you cannot place the blame on them for the method this man choose to kill nor what he did after.

I guess some Thanksgiving meals will not be cooked this holiday as they have already been burned. It is very sad that this had to happen. The dog owner was negligent. The chicken turkey owner reacted to an extreme. I think the real truth about the entire event still remains to be seen. Beating dogs of this size to death with a shovel is very suspicious. What the turkey (pun) should have done was coral the dogs, call animal control and see judge Judy about restitution. There is much more to this story to come. We should call in Ace Ventura as soon as possible. Dog owners should remember the fate of your dog is in your hands as they are your responsibility. End of story.

Wow, Medium rare in the east, can you read? It says the people understand the whole trespassing part, they just want to know why the guy didn’t call them and let them know. Besides ‘defending livestock’ definitely does not involve beating dogs with shovels and then burning and burying them, that is plain cruelty. Defending livestock means to make sure the intruders cannot harm the animals that provide for your family, not torture them to death. You’re a troll and need to go back to troll country.

If the animals attacked the livestock as reported, then legally they were within their rights under the law. Had the gentleman who killed the dogs simply left the site intact and contacted the authorities, there would be little room for speculation, however, the method utilized to dispatch the dogs and the subsequent actions taken now give the appearance of improprieties and potentially cast doubt on the validity of the report.

Brentwood Police and Contra Costa Animal Control were already investigating this incident, but with all four local news channels (KTVU, KRON, KGO and KPIX) in the Bay Area picking-up this story, public outcry and national exposure will drive even closer scrutiny and an expedited reporting of the investigation findings.

We will be monitoring this story closely…

I know these owners personally. I knew the dogs personally. The owners are not morons. They rescue dogs from high kill shelters, as do I. They have saved over a hundred dogs, now adopted out to loving families. These two dogs, also rescues, were in no way aggressive. I don’t claim to know for sure what happened at the “ranch,” but your denigrating comments about the owners are ‘way off base.

And do notice that you’re one of the very few here posting anonymously, and clearly the most aggressive in your posts. These are not the actions of a secure, civilized person.

this guy sounds like one sick man. why couldn’t he just call the police or animal control? it seems like this guy was just looking for an excuse to kill something. why did he try to hide the evidence?

Somebody needs to take a shovel to Medium Rare in East County
head, burn him/her and bury it… He is as sick as the *ucker that beat these dogs… He most likely is the sick *ucker that savagely murdered these poor dogs…
