Petition Filed with Calif. Supreme Court Seeking Stay of Governor’s Illegal Payments to Undocumented Immigrants

by ECT

San Francisco — Two clients represented by The Center for American Liberty’s lawsuit, in coordination with The Dhillon Law Group, filed an emergency petition to the California Supreme Court yesterday requesting the Court immediately stay Governor Newsom’s appropriation of $75 million to unnamed regional non-profits so they can in turn provide $500 checks to unemployed undocumented immigrants.

You can view and download the emergency petition for writ by clicking here.

California and federal law both prohibit the extension of unemployment benefits to undocumented immigrants. Further, appropriating gifts to an organization outside of the exclusive control of the State violates California’s Constitution.

The lawsuit names California Governor Gavin Newsom and the state’s Director of the Department of Finance, Keely Bosler as defendants in their official capacities.

“The Governor made clear in his comments that he is giving $75 million in lieu of unemployment benefits that state and federal law bar to aliens working here illegally,” said Chief Executive Officer of the Center for American Liberty, Harmeet K. Dhillon. “It is also concerning that unnamed nonprofits, who have no accountability to the taxpayer, are going to receive and distribute taxpayer dollars.”

“This is taxpayer money that may only be appropriated by the legislative branch. This is not a slush fund for the Governor to spend as he sees fit,” Dhillon said. “Governor Newsom is ignoring the proper, and constitutional, channel to appropriate funds. At a time when law-abiding Californians are crushed by unemployment, housing issues, business closures, and massive limitations on our normal lives, Governor Newsom is doing an end-run around the legal guardrails in place. There is no accountability over the distribution of these funds to individuals legally not entitled to cash benefits. The laws apply to everyone, even the Governor, and we hope the California Supreme Court will agree.”

ECT:

Please, less press releases from politicians and organizations with axes to grind. More news.

I am glad he posted it. This site annoys me with all the Attorney General Xavier Becerra postings and Kamala Harris garbage. Nice to see some fair coverage for a change. Not like we will see this time of lawsuit on any other local media. Everything is a political ax to grind. get over it.

Gifting my taxes to illegals is wrong. There are too many legals that are much more entitled and in need (not that I support giving any tax revenue away) I also believe diverting public funds to non citizens by local government is breaking the law of California’s constitution too. Politics are being abused by Newsom and the far left in an attempt to dilute our liberties and rights. This is a very dangerous path to follow in the only real country that is suppose to be free.

This is great news. Now we need to go after Governor Nuisance for giving the illegal invaders free healthcare, which is also illegal.

Eliminate all incentives for illegals. Then some will consider to come in legally. Fact is, it is currently so much easier to come here illegally.

It’s easier for people to immigrate here if they have a sponsor which will guarantee them housing and jobs. I have sponsored over 200 people —- FROM EUROPE (France, Germany, Italy, Austria, Norway, Russia) .. and they got here with no problems and are contributing handsomely to our society —– and none are lettuce nor strawberry pickers. After this Chinese Virus scare is over, I’m sponsoring even more.

Newsom thought he’d pull a fast one by giving those millions of OUR tax dollars to non-profits to distribute. He must think we are totally stupid! Nice try, Gavin! I love how they use the term “undocumented immigrants” …….. they are ILLEGAL ALIENS, not “immigrants.” Immigrants go through A PROCESS to gain entry into a country and many times they are REJECTED. People who are accepted get GREEN CARDS which make them resident NON-CITIZENS …… but they are here LEGALLY.
