Brentwood Attempts to Correct Misinformation Regarding Proposed Emergency Shelter Ordinance

The City of Brentwood put out a press release Monday afternoon hoping to correct misinformation being spread by local residents regarding a proposed zoning location its emergency homeless shelter ordnance.

According to a homemade door hanger notice, it states the City of Brentwood is “funding and building” a homeless shelter. Per city officials, they say that is not true and the only action the city will take is to zone to allow for the use of a shelter as a permitted use.

The press release states:

The City of Brentwood has not in the past and does not currently offer homeless programs. It has no plans to establish a homeless shelter. Designating the Davis Camp site at 1907/1909 Jane Way (or any other site in the city) will bring the City into compliance with State law and would not entail any obligation to actually establish a homeless shelter.

The State law does not require that a shelter be built, only that a potential site be provided in the zoning ordinance and zoning map.

Press Release: PROPOSED EMERGENCY SHELTER ORDINANCE

BRENTWOOD, CA – State law requires all cities to provide for emergency shelter uses in their zoning ordinances. At least one location in the city must be zoned to allow a shelter as a permitted use. The City of Brentwood is currently not in compliance with this law.

The City of Brentwood has not in the past and does not currently offer homeless programs. It has no plans to establish a homeless shelter. Designating the Davis Camp site at 1907/1909 Jane Way (or any other site in the city) will bring the City into compliance with State law and would not entail any obligation to actually establish a homeless shelter.

To comply with the State law, the City has been reviewing potential sites to rezone for a shelter use.

At a recent joint workshop, the Planning Commission and City Council agreed to move forward with the City-owned former Davis Camp site at 1907/1909 Jane Way for further consideration.

If the Davis Camp site were to be zoned, the existing zoning (which allows residential development) would not be replaced – an emergency shelter use would be added to the existing list of permitted uses.

The Planning Commission is holding a meeting on April 7, 2015, at 7:00 p.m. in the Council Chambers at 150 City Park Way. The Planning Commission will make a recommendation to the City Council of a site that will allow an emergency shelter use as required by State law.

The City Council will consider the Planning Commission’s recommendation on April 14, 2015, also at 7:00 p.m. in the Council Chambers at 150 City Park Way, and may make a final decision on the zoning location.
