Bill to Help Students Recover from Lost Learning Time Advances to State Senate

SACRAMENTO California students have missed out on crucial learning time during the COVID-19 pandemic. On Thursday, the State Assembly passed Assemblywoman Lorena Gonzalez’s (D-San Diego) Assembly Bill 104 on a 77 – 0 vote to provide families with a flexible menu of options to help K-12 students recover from lost instruction time.

“Now that our kids are returning to the classroom, we need to focus on supporting students who have fallen behind and lost a year of educational progress,” Assemblywoman Gonzalez said. “AB 104 provides students and parents with immediate steps they can take to help their children get back on track.”

Gonzalez’s urgency legislation helps ensure California students aren’t penalized for educational setbacks during the pandemic and targets recovery options that support students’ individual learning needs.

Retaking Grade Level 

AB 104 requires school districts, county offices of education, and charter schools to implement a temporary policy allowing students to retake a grade.

The bill requires that parents are notified on or before June 15, 2021 of their ability to request their student retake their 2020–21 grade level for the 2021–22 academic year. Following a request, the school would consult with the parent, student, and student’s teacher to determine whether this option would be in the student’s best interest.

Student Grade Reconsideration

Under the bill, students enrolled in high school during the 2020-21 school year would have the opportunity to change letter grades to a Pass or No Pass grade on the student’s transcript. A student’s GPA and ability to access to state financial aid for higher education would not be negatively affected.

5th Year of High School

Schools would be required to allow students who are enrolled in their 3rd or 4th year of high school during the COVID-19 pandemic to complete their high school graduation requirements, including an option to enroll in a 5th year of instruction if that would enable them to graduate with a high school diploma.

The biggest thing this bill would do is allow seniors to graduate with CA state’s graduation requirements (130 credits) without fulfilling local educational agencies (districts) additional graduation requirements (200-240 credits.)

SEC. 3. Section 51225 is added to the Education Code, to read:
(1) Exempt a pupil who was enrolled in the pupil’s third or fourth year of high school during the 2020–21 school year from all coursework and other requirements adopted by the governing body that are in addition to the statewide coursework requirements specified in Section 51225.3.
