Assemblyman Gallagher Requests Transparency for Firearm Regulations

SACRAMENTO – On Wednesday, Assemblyman James Gallagher (R- Yuba City) wrote a letter to the Department of Justice and the Office of Administrative Law (OAL) requesting additional time for public comment on proposed regulations to ban large capacity magazines.

“Five days is not nearly enough time for the public to review and comment on these regulations, especially when considering that the regulations were submitted during the middle of the holiday season.  Two of the five days allowed for comment were Christmas and Christmas Eve.  This is not how we should be implementing controversial laws that affect millions of California gun-owners,” said Gallagher.

The Department of Justice submitted the proposed regulations to the OAL on December 23rd, with the last day for public comment being December 28th.

The regulations implement Proposition 63, which makes it an infraction for a person to possess any large capacity magazine.

The Department is using the emergency regulatory process to draft regulations to implement this ban, even though the ban does not require a person to dispose of their large capacity magazines until July 1, 2017.

What bothers me is not the subject of the law but the disrespect of people who vote in California. Give us time to read and comment.

Exactly said!

Some of us voters might not read too quickly, while some others may make simple mistakes and would need several attempts to understand these ‘laws.’ Remember, ‘laws’ are written in ‘law-like’ language and not ‘common speak’ language that you and I use. (Such as the overuse of words like ‘therefore’ and ‘whereas.’)

For example, a law to ban the use of machine guns might be written, “Therefore, machine guns will not be carried in any municipality of California, whereas.” And it would be reasonable for such to be misinterpreted as “Give everyone a kitten or puppy!”

We should have a ‘law’ that would require any ‘law’ restricting gun ownership or use to be proposed at least three months or one year in advance, so everyone has a chance to fully understand and comment or march in opposition.

It would be nice if there were another ‘law’ that would allow any ‘law’ which would un-restrict gun ownership or use to be immediately implemented when proposed. But I won’t hold my breath waiting for such respect to be given to us. Whereas.

Dispose of magazines? Large capacity or not, this is ridiculous. Is the Government going to financially compensate for that which was purchased legally? This is completely unlawful and thank goodness the NRA is all over it.
