Contra Costa County Pulls Permit from Lumpy’s Diner Over Health Order Violation

A day after the Contra Costa County Board of Supervisors told health officials to shut down restaurants and continue to fine them should they refuse to comply with the County Health order, Lumpy’s Diner in the City of Antioch was temporarily shut down due to health order violation.

The diner was shut down Wednesday and Thursday morning was still closed pending approval to reopen. The owners of Lumpy’s said they have sent an email to the county of corrective actions and hope to reopen at some point in the next 24-hours.

Under the health order, restaurants who do not check customers proof of vaccine against COVID-19 or enforce masks, could face fines of $250, $500 or $1000 or ultimately could have their permit pulled.

On Tuesday, Anna Roth, Health Services Director, told the supervisors during the month of November, they had 99 complaints with 13 still in the enforcement process—80 different businesses.

In response to no fines, Supervisor Karen Mitchoff blasted County staff for not enforcing the health order.

“It seems to me that the time for education is over, the time for providing information is over, under the ordinance, the ordinance has progressed to the area where we need to be citing or issuing documents to shut them down,” stated Mitchoff. “The press is watching this very careful as is the public and I would like assurance that this week those types of actions will be taken. We have done the informing, we have done the educating, and its not fair to those businesses who are complying. Its not fair to the employees of those restaurants, patrons choose to go there, but employees work there.”

Roth said the complaints are now going directly to her office, however, Mitchoff was not impressed.

“I appreciate that but we are beyond that,” stated Mitchoff. There are businesses out there that you are aware of who have gone through all that administrative escalation. Are there 13-outliers out there who have gone through the fines, they have gone through the education they have not received that notice that its time to shut down. That is what I think this board needs to have assurance on.”

In October, multiple In-N-Out Burger restaurants were shut down by the County for not following the Health Order, however, they since reopened with drive-thru only.

COVID Overview in Contra Costa County

According to Anna Roth, Health Services Director, she shared the county had 1,284 cases of COVID-19—at one point, they were at 9% positivity rate on Nov. 23 and are now at 2.8% and explained the average case rate per 100% is very different based on vaccination status. That rate is 14.6 per 100,000 for unvaccinated while its 4.7 per 100,000 per vaccinated. 27 people are hospitalized with COVID-19.

“Unfortunately, we are still seeing one COVID death per day on average with 31 deaths since Nov. 7 in our county,” said Roth.

Roth highlighted 75.6 of Contra Costa County residents are fully vaccinated.  The county had a goal to get to 1 million doses by July 4, they met the goal by Memorial Day and as of last Friday, they hit 2 million doses of vaccines given in the county.

“This is a tremendous accomplishment and I want to acknowledge all the staff, employees across the county as well as the partners across the county. This is a very big accomplishment,” said Roth.

For children 5-11, they now have 30.9% of those who are now vaccinated with events through December.

As of Tuesday, there is no Omicron variant within Contra Costa County explained Roth who said its in the Bay Area—Delta variant remains prominent variant.

When are the people going to wake up and realize they have the power to stop this bs. Remember we pay for there services to slow us to conduct business. So how about we all refuse to pay how long will they survive with no revenue? Municipalities don’t create jobs they cost them with lazy ass service and availability. Think about this deal with city county state services and tell me I feel like I where served well and adequate. Are you happy with DMV ? Post office ? City offices ? State offices ? Need I go on ? So you support local businesses by shutting them down? Obviously, the customers feel safe eating at Lumps but you beurocrats have to push your weight around. More illegal mandates to kill CA business and the towns economy. Way to go! Please don’t say”rules are rules ” because we all know Comrade Newsom doesn’t even follow his own rules!

I’m vaccinated. I think everyone should get vaccinated (but the choice is up to them).
With that said, it is crazy that Contra Costa County is forcing restaurants and other businesses to be “vaccine police”. What’s going to happen in a few months when people need a booster to be considered vaccinated? Businesses will need a person at the door with a degree in “vaccineology” to understand if someone is vaccinated? Covid is not going away anytime soon. I feel very sorry for businesses especially small businesses that have to continue to deal with these incompetent bureaucrats.

No governor or health officer has the authority to shut down your business without due process of law. That means no Sheriff or health officer can close your business or revoke your license without a hearing. No emergency or pandemic suspends the law. There needs to be evidence that your business is unsafe.

Lumpy’s is a good place and employs great people, but I have no sympathy for them…..Lumpy’s did this to them themselves. What else can you say and complain about it????
