Updated: Brentwood Ice Cream Man Arrested After Being Accused of Selling Drugs

On May 21, 2014 at approximately 3:00 pm, a 30-year-old resident in the 200 block of Mountain View Drive reported Kelly Robin Brown (62 yoa, Oakley resident – Ice cream truck driver) attempted to sell him a small quantity of suspected Methamphetamine when he ordered ice cream.

Brentwood officers responded to the area and located Brown in the parking lot of the Arco AM/PM service station.

Brown was contacted and placed under arrest for transportation and possession of Methamphetamine. He was booked into the Martinez Detention Facility and the case will be sent to the District Attorney’s Office for review.

There were no children involved in this incident.

Actually they found NOTHING in his truck or on him. They drug dogs didn’t even respond to anything. The truck wasn’t even impounded. I know because I pick up the ice cream truck and talked to the cops watching it. They arrested because someone accused him. He never offered drugs or used drugs. Kelly also has no previous record of any kind.

Innocent until proven guilty sweetheart, now if you have tangible proof of guilt, then by all means come forward, otherwise you’re eating out of the same doggy bowl like everyone else. When you get accused of something you’re innocent of, and when your name and face is plastered all over the media, please do tell us all how wonderful it feels to be tried and convicted before a trial is even held.

This has been going on for many years in the East County area. A group of longtime residents have been trying too get this understood, but felt their concerns were ignored. Thank you Brentwood police Department for believing! Can we get all law enforcement in East County to work with the same ethics as Brentwood.

They said that he was being accused not convicted. I know for a fact that they didn’t find anything in his truck or on his person. That 30 year old that called him in, more than likley set him up. Even he drug dogs showed no responses to any drugs being present. But does the media present those facts? NO! The truck wasn’t even impounded. That just proves that you people need to get the facts before slandering a person.

I just find it so sad that everyone just wants to assume that he did it. Anyone ever think that this man has a family and that this is his business. What happens if they find that they have to evidence to prove this alligatio? Will all these shit talkers post an apology? Guess we’ll find out.

I’m wondering if the person that made the accusation is being looked at? Could he have been thinking he was being watched and had to pass the drugs off to clear himself? How about we look at it from that angle? If everyone is going to be trash talking how about we slander everyone’s name.

Pass what drugs off? I thought everyone is saying that there were no drugs and the drug detection dog didn’t alert on anything. Until I see something in the news that he was released and all charges dropped I’ll assume that BPD has a viable case that will be forwarded to the DA for prosecution.

You know what, that person should be looked at. If he’s going to make a bold accusation like that to destroy a mans reputation and livelihood, then he should be looked at closely. Too many innocent people have been put away because of a lie, as is the case in this situation where Kelly is being tried and convicted in the absence of evidence and proper police procedure before a trial has even begun.

For the ice cream truck driver to be innocent, you’d have to believe ALL of the following:

1. The driver ACCIDENTALLY gave the customer $2 in change, instead of of the $17 he was supposed to get, and
2. The driver was unaware of the baggie of dope “stuck” between two thin dollar bills, and
3. JUST BY COINCIDENCE, the baggie of dope was a $15 sack, which just happens to be the same amount the driver shorted the customer on when accidentally giving the wrong change.

Anything is within the realm of possibilities, but if you believe all three of those things occurred, then I have some ocean-front property in Arizona I’d like to sell you.

Just curious as to where you heard of these so called “facts”? Because if they are not coming from the actual police report, which I doubt has been made public yet, and you are just flapping your mouth with your opinion then one could say you are slandering an innocent person. Comments posted on the Internet are on permanent record and you can be held liable if not proven to be true.

Innocent or guilty this is affecting the kids. He has been delivering for years to the kids I teach and they were all totally overwhelmed and some scared when this broke two days ago. I hope we get an updated update when all is said and done. We need all people who work around children to set a good example and have integrity.

Totally agree with Frankie about the accuser could possibly felt pressured & wanted to get the drugs off himself.

It also wouldn’t surprise me that the media is quick to tell a “story” vs. getting the facts.

I’m sorry the 30 year old didn’t want the drug, yet he still took it to call the cops? At this point I question why the cops didn’t think that this was the 30 year old meth.

Lessened learned here is that if you live in Brentwood & need to figure out how to get out of trouble with the law? Go find someone to accuse!
