Brentwood City Council Votes to Better Streamline Special Event Permit Process

In an effort to ensure putting on a special event becomes easier on the public, the Brentwood City Council unanimously approved changes to its approval process.

The City Council approved a rezone (RZ 15-001) amending the City of Brentwood Municipal Code, Chapter 17.850, Temporary Use Permits (TUP) to establish procedures and standards for the granting of temporary use permits for short-term activities on private property.

The temporary use permit requirement will be required only for special events on public property and the MOU requirement will be eliminated for nearly all Special Events and TUPs, avoiding the need for City Council approval.

All approvals will be handled administratively by City staff, with one staff person serving as the point of contact, with final review, if necessary, by the City Manager.

Vice Mayor Joel Bryant was glad to see the new process.

“I just want to thank staff for working to streamline some of these issues we have had, its going to be really great for the community to come in and have this procedure in place,” said Bryant.

Councilman Erick Stonebarger stated if more revisions need to be made, that Brentwood continue to work to improve the process.

“As we go through this, along with special events permit and we enter this year with this and we do a few, if this needs to be tweaked and adjusted to make it an easier process both from a community standpoint and a staff standpoint, then lets dust it off and fine tune it a bit more if we can”

The costs related to this ordinance revision includes staff time to process any permit applications, which will be offset by the $50.00 minor temporary use permit or the $732.00 temporary use processing fees for short term activities on private property.

RECOMMENDATION

Introduce and waive the first reading of an Ordinance of the City Council of the City of Brentwood approving a rezone (RZ 15-001) amending the City of Brentwood Municipal Code, Chapter 17.850, Temporary Use Permits (TUP) to establish procedures and standards for the granting of temporary use permits for short-term activities on private property.

PREVIOUS ACTION

On November 12, 2014, the City Council was updated on revisions to the Special Events Permit application process. Staff proposed that the responsibility for processing these applications be moved from the Community Development to the Parks and Recreation Department, which already handles special events and rental of City facilities. In addition, City Council directed staff to continue to revise the process and work with community groups to streamline it, make it more efficient, reduce costs, and be user friendly. Staff was directed to simplify and finalize the application form and process and make the necessary policy revisions and ordinance changes.

On April 28, 2015, staff presented to the Council revisions to BMC Section 7.01 (Definitions) and 7.02.020 (Special Event Permits), which will govern the new process for Special Event Permits, and the repeal of Council/Administrative Policy 50-2, which will be replaced by a new Department Policy (Parks and Recreation Policies/Procedures No. 00-33, Special Event Permit Application). At that meeting, the Council vote to introduce and waive the first reading approving the amendments to Section 7.01 and 7.02.020 of the BMC.

BACKGROUND

The City of Brentwood enjoys many varied special events throughout the year. These events are an important part of the community and add significantly to the quality of life for residents and visitors. The City’s intent is to encourage high-quality events that align with the City’s economic, civic and community development goals and to better serve and to continuously improve the quality of life for residents.

Together, the proposed Chapter 17.850 TUP revisions before the City Council for final approval, along

with previously approved revisions made to Sections 7.01 and 7.02.020, will authorize staff to implement an efficient and expedient process for applying for special event permits, on both public and private property.

To complete this entire process and establish this new special event permit, a text amendment is also needed to Chapter 17.850. The proposed changes to Chapter 17.850 distinguish between TUPs and Special Event Permits, with the former taking place exclusively on private property and the latter taking place, in whole or in part, on public property.

An inter-departmental team will work together to coordinate processing of the TUP application.

PLANNING COMMISSION RECOMMENDATION

The Planning Commission considered the proposed ordinance in a public hearing on April 21, 2015. After questions and answers and solicitation of public comments (there were none), the Commission voted unanimously to approve Resolution 15-012, recommending that the Council adopt the proposed ordinance as presented by staff.
