Antioch Man Dies in Bay Point Industrial Accident

Here is some sad news out of Bay Point as Natalie Neysa of the Alund Bay area News Group is reporting that a 26-year-old Antioch man died Monday after being crushed by a mixer at Hankel Corporation.

David Eleidjian, 26, of Antioch, a temporary employee working for an out-of-state company at Henkel Corporation in Bay Point, suffered a life-threatening injury in the incident, Cal-OSHA spokeswoman Erika Monterroza said Tuesday.

Contra Costa Fire District officers were called at 11:19 a.m. to Henkel, at 2850 Willow Pass Road, for a report of someone injured by machinery, said fire spokesman Steve Aubert. Emergency crews found a man suffering from major injuries and took him to John Muir Medical Center in Walnut Creek, where he later died.

About 11:30 a.m., Cal-OSHA representatives were informed of the incident at Henkel, visited the site and opened an investigation, Monterroza said.

She said Eleidjian, who worked for Tennessee-based HR Comp LLC, was operating an industrial mixing machine when he was caught and crushed. His legs were amputated and he later died from his injuries late Monday afternoon, she said.

“It’s a dual employer investigation because of the fact he was employed by HR Comp, but working under the supervision of Henkel,” Monterroza said.

HR Comp has been involved in several illegal activities in Tennessee including operating without a lease staffing / PEO license in 2010 and was fined by the State insurance commissioner’s office.

According the CA state website for verifying if a company has workers’ comp insurance HR Comp does not show any workers’ compensation since April 2012. This is a huge criminal violation.

I have read the article you posted and every person’s post (including the one who attempted to defend her) was true> I know someone who worked for her and I can tell she is more evil than even the posters have written. This about the tenth post I have read about her and HR Comp or the ten other names they go by. Only two people have attempted to defend her.

Why is the state of CA not doing anything about her not having insurance for over a year yet she has many PEO (the state thinks they are staffing agreemts) agreements which makes HRComp 100% responsible for the worker’s compensation on the youg man who died and the many other employees they have under contract through a PEO agreement (a PEO is where the PEO puts all the clients employees under their EIN number and then leases the employee back to the client making the WC 100% the PEO’s responsibility) In a staffing agreement the employee belong 100% to the staffing company and the staffing company is 100% responsible for the WC. Either wayHRComp should be held 100% in violation of insurance fraud. The woman is a person who does not care about the citizens of CA if you look at her total disregard for the financial interest of the clients she has obtained through broker’s good names and being thousands of miles away so no one knows her awful reputation and illegal activities which if know would have most likely prevented those companies for doing business with her.

If you have done business with any company having HRComp in the name I would strongly suggest you contact your WC department to see if you are even covered for WC insurance. If you have done business in the last year with HRComp I would take a look to see if they put your company at risk even though nothing happened. If you are an attorney I would say you have a possible class action lawsuit you could bring against this company and its owner.
