Special meeting: Antioch City Council to Consider Temporary Moratorium on Evictions

On Tuesday night, the Antioch City Council will be holding a Special City Council Meeting to potentially adopt an ordinance to place a moratorium on temporary evictions for residential and commercial tenants who are financially impacted by the Novel Coronavirus (Covid-19).

According to the agenda, the urgency item will need a 4/5 vote of the City Council for approval and would provide residential and commercial tenants with a defense to a landlord’s unlawful detainer action, which is an eviction with notice.

If approved, the proposed Ordinance establishes a moratorium period for residential and commercial evictions due to non-payment of rent caused by certain Coronavirus related impacts during the Coronvirus pandemic. The Ordinance provides temporary forbearance to those who qualified by providing six-months to catch up on unpaid rent and forbidding late fees from being charged for qualified tenants.

The move comes after a March 16 order issued by Governor Gavin Newsom who issued Executive Order N-28-20 which allows local governments to consider a moratorium on evictions.

The Ordinance requires tenants to inform landlords in writing of their inability to pay full rent within 14 days after rent is due after they become aware of a substantial decrease in household income or business income or out-of-pocket medical expenses that would prevent them from paying full rent.

According to the City, the Ordinance temporarily relieves the tenant of liability for the unpaid rent. The landlord may seek any unpaid rent after the expiration of this Ordinance. The tenant must pay any unpaid rent within six (6) months of the date of expiration of the Ordinance, unless a state law or order is amended or adopted providing for a longer repayment period. If so, the longer repayment period of the state law or order shall apply under this Ordinance. The Ordinance does not establish rent forgiveness.

So let’s say the tenants do not pay for 3 months and decide they choose to be evicted. Landlord must take to court and probably take another 3 months. My question is since the city decided to let tenants not pay for 3 months which led to another 3 months, is there any way else we can screw landlords? Just saying.
