Letter Writer Says Antioch Council’s Moratorium on Evictions Out of Line and Overreaching

The following Letter to the Editor was submitted in response to the Antioch City Council Passes Temporary Moratorium on Evictions for Residential and Commercial Tenants this past Tuesday.

Dear Editor,

I had submitted a written statement to the Mayor in objection to any action by the City of Antioch concerning overreaching and rental contracts to which the City is not a party.  The action by the City in this matter is unnecessary and largely disingenuous.

The City of Antioch has failed year after year, decade after decade to protect the homeowners who live in Antioch. Initially an inspection process for rentals was instituted to hold tenants and landlords accountable for poorly maintained property.  In the crash of ’08 that went belly up and the City has done almost nothing for the last 12 years.

Then as a citizen’s initiative Measure O was passed creating a business license fee for rental properties. No services have been directly provided to anyone for the fees collected. The inspections were not restarted. Another fail. And, oh yes, because no service is directly provided for this tax there may be a Prop 218 violation.

Now, the council steps forward to interfere in rental payments.  It might help if just one of the council members owned an investment property here in Antioch.  As far as I know, none do.  So, we have five people with little or no experience in the business taking destructive action.

Concerning the County Courts, and I can confirm; no, Mr. Thorpe you cannot file an eviction at this time.  The courts are not accepting them.  And based on the closure, they won’t be filed for at least 30 days.  Additionally, even if a tenant has been served a 3-day notice to pay rent in Contra Costa County the courts have extend that notice period out an addition 10 days before they will even accept the filing.  It is questionable if the County courts have this right because it hasn’t been litigated yet.  Best guess, it will be found in violation of the State Constitution.

In my business we are allowing tenants who have found themselves without work, ill with CN-19 or taking care of a family member sick with CN-19 to defer part of the rent.  We are not waiving or cancelling rent. We require a written statement from the tenant attesting to the statement above.

The City Council is totally out of line, overreaching and in my opinion using this measure as a springboard for reelection.  If you want to help, help the property owners who live in town and care about value, quality of life and services.  Get the homeless issue under control, begin inspection of rental properties again and hold rental owners and tenant accountable.  And, provide some direct services to those of us who pay the taxes here in town.

I applaud Mark for this letter. I don’t agree with him on many things over the years as he has spoken on a variety of issues. But this one he is 100% correct. Antioch exceeded the governors orders which highlights you have five councilmembers who went above and beyond their ability. I am most ashamed by Lori Ogorchock who knows better than to support something like this and should have voted against this given she is a real estate agent and knows plenty of landlords who are already giving breaks to those who rent from them. I have also lost all faith in Sean Wright and think someone who is not already on the city council needs to challenge him for the mayors seat.

Antioch has completely lost their way.

I agree on the homeless problem that this Mayor and counsel don’t ever address. We have an order from our governor to shelter in place so we can stay safe and help the spread of this deadly COVID-19 but yet these homeless are still wondering and camping out on our streets and shopping center store fronts especially on A & E.18th Sts. It smells like a sewer because the relieve themselves right on the side walk, they leave there stolen shopping carts full of garbage all along the streets. These homeless are always coughing, sneezing and spitting everywhere and are probably carriers of this virus. This city counsel doesn’t care about the citizens they agree all greedy and made sure they gave themselves a huge raise and told the voters that put them in office all about it on this publication. They all have been ignoring this problem for years and now our lives are at stake and they’re still doing nothing. This order is to be obeyed or your breaking the law. These homeless are doing so day after day, so that being said this city counsel and Mayor are also breaking this order and the law for not doing something with these homeless to keep them off the street and the city safe. As far as I’m concerned we have no Mayor or counsel in Antioch because they’re not worth the title they were voted on. Antioch is becoming Antioch Rivertown Slums.

Antioch Homeowner, we provide professional property management. Most of the rentals we manage for investors are the best homes on the street. The owners of the rental property we manage worked and saved to own investment property. Most are not rich and depend on the rent collected to pay mortgage payments or use the income for retirement.

Both of you are entitled to your opinions , however facts are different, and they do tend to be stubborn.

I feel sorry for you and your family. Trump is doing a fantastic job on this crisis. Far more than presidents in the past. He even accomplished all the leadership action with the political opposites putting up every roadblock they can without considering the lives they affect. This president created enough jobs to employ all the homeless before the virus. He will bring them back after too. It is not his fault the California politicians are more concerned with buying votes with my tax dollars than the virus or unemployment. Socialism only works until you run out of other people’s money. As a close friend to several private and commerical investment owners, I’ve witnessed the level of greed that has taken place in this world. I honestly don’t know when or if land lords and property investment companies will ever stop with the greed. Yes the mortage went up a little, and a few taxes added, but not enough where the tenant’s rent should be to an unbearable amount. Greed comes with many problems. For years these big investment companies were buying up properties, kicking out the section 8 and affordable rental tenants. Oh but look how God switched things around, now the landlords who cared about the section8 and the affordable rentals are the only ones getting paid!! Oh and this is only the beginning, just think about all of the evictions thats coming, overwhelming the system. You greedy landlords, brace yourself!!!

Are you going to open up your home to help these people? None of us asked to lose our jobs. Not one single person. You want to throw out people who may be positive out on the street and further expose all of us to the virus. Will you be paying all of our medical bills if your actions expose the entire city even more to the virus? Read the order. You will eventually get your rent. Do you realize they will have an eviction on their record which will prevent them from renting in the future? I fully understand your position but it appears that you possibly still have a job so perhaps the stress of this situation isnt affecting you like it is for the renters. Everybody is trying to survive right now. How about you try having a little compassion and understanding for the people that lost their jobs and have no way of paying for their survival. You are absolutely Despicable. I commend the council for looking out for the people of Antioch. Regardless of their qualifications they have heart and love for this city. When half the town is homeless and can’t get a place to live because of the eviction are you gonna find shelter for the homeless and fund it? Everyone knows this city already has a huge problem with the homeless. You just want to add to it. To our crime rates. You don’t think people will get desperate and resort to crime for survival? You are a fool then.

I’m sorry… correct me if I am wrong but, homeowners have far better protections than renters ANY DAY! While millions of renters had the rug pulled beneath their feet just two weeks ago, they face eviction once things stabilize. I really hope Governor Gavin Newsom signs a rent forgiveness law like the government signed into law mortgage help for homeowners.
Renters are people who PUT money into the HOMEOWNERS HANDS that rent their property! TAKE CARE OF YOUR RENTERS!!!!!!!

This state is very pro renter vs the rest of … the world.

I had a property that I used to rent out and it was horrible. Tenants in this state feel they are “entitled” to the owners house. Owners have an asset they can possibly lose if it is not taken care of or paid for. For a renter your home is a liability, you have no ownership.

I also hope Newsome signs a rent forgiveness, but who pays. I hope it’s not a landlord with a house they’ve rented out. Maybe the state can do what California does best and tax everyone to pay back tenants and/or landlords.

By all means take care of your renters, but when it comes down to losing your home, hurting your family, etc. The one borrowing your other house really is going to suffer because I don’t owe that person anything, and I would need to protect my family.

Look I paid my rent on time every month and I as long as i have job i will continue to do so and i am sure most folk renting feel the same as I. I also like to believe because i am a good customer to the business owner of my home that should i lose my job they be understanding and work with me. While i think the city of Antioch is correct in protecting Renter. I think the City should take ownership of managing who qualify for rent protection , by making the renter apply to the city for the protection and have the city work with landlord on a fair time limit and in return for giving those renter a chance to get back on their feet.. The landlord should get some tax relief and the defer rent can be added to the renter monthly rent once they are able to pay. It always funny that when any relief come from the government the folk who get it most is business and owner ..As if everything they got they got on their own..one day i hope the folk who yell we are a capitalist system learn it working folk buy crap that make it that way..

Right now if they were to call the mortgage holder there is a 90% chance that their payments will be postponed then added to the end of their loan. Most times us renters are the ones paying the landlords rent and then some. Yet us renters are looked down upon Because we are not owners. Never realizing some people choose to rent vs. buy. If something like a deadly virus comes to town and the government shuts the state (or more than 98% of the country) down TO PROTECT US from disease and death, we have no protection like homeowners. The biggest thing we haven’t mentioned is the lack of building a good reputation here in Antioch. A good reputation is our everything. If we allow there to be high crimes, theft, homelessness, and disorder here in this city everyone will know and not want to come to this city do business with a government that doesn’t care about the basic quality of life everyone needs: saftey, security, and commerce. Stop building homes here there is no jobs here. Stop taxing us money isn’t going to make anything better. Making good decisions is going to solve problems in this city.

An answer to the comments noted above from Mark Jordan.

No landlord is creating homeless issues. Landlords provide housing to those you are not yet home owners. The United States of America is a nation of laws. Not feeling or opinions; but of laws.

The reason that federal housing projects are no longer being built is because the federal government wasn’t good at managing housing. So where we are left is with are laws that govern the execution of private contracts and private property. Private contracts are either legal in all terms and conditions or they are not. Generally if one term or condition is not legal that does not invalidate the entire agreement.

Interference in a contract to which one is not a party is a tort. Damages often occur when a tort is committed.

When the municipal government interferes and overreaches beyond what is in the State Constitution or an Executive special order (which is what is happening in Antioch) that is a violation of California law. We do not govern by dictate in the United States of America. We are not Russia or China. Private property rights are a foundation of a free society. And, municipal City councils cannot do whatever they want on a whim.

I won’t comment on the personal attacks or opinions.

Let’s be honest the government has nothing to do with a person’s doings if I invest in property as income why am I subject to loss of my income because I have a property I still have a mortgage on that property that I have to pay that will go into default so why do s*** not roll down hill the government is no policy or business telling renters they don’t have to pay everybody supposed to live with the safety net if they don’t it’s because of them it’s their habits they’re drug addiction alcoholism whatever problem is holding them down its there’s not the landlords problem and yeah go Trump you shouldn’t get nothing if you don’t pay taxes. Not every homeowner is the same as these corporate overlords. I own a rental property here in Antioch and also live here. I charge only 15% more than the mortgage, taxes and insurance. The rest covers future upgrades and other things.

Mortgages are not cheap for those who do not put down large amounts. I worked my butt off for 20 years to be able to save the bare minimum to finance and get this home. If you want to live in a world where you can live rent free and get everything equally then I assure you flights will be available again soon.

This is America, we have laws, we have principles and most importantly we have a constitution.

Our mayor and council members are crooks using this as a big for re-election. Funny how they never cared about you before when the voter pool was switched.

People or companies owning multiple properties need to either follow the law or sell their properties.
This is a monster real estate people and “investors” created when you all bought properties for basically cents on the dollar during the Housing Bust 10 years ago and turned Antioch into a ghetto.
So if you think people who pay a mortgage yet have to live next to a few of your “investments” are going to come to your rescue November I think you’ll be very disappointed.

I never understood why someone would want to get stuck owning a house! It ties you down! You can’t just get up and go at a moment’s notice. I much prefer to rent and then leave when I want and travel or go into another country. Now, a good size yacht is much better. It can get you places and you don’t have to unpack. Your kids will get an education no school can offer if you’re tied down.

This is all very funny. You people are talking about homelessness and wanting to solve the problem but yet you wanna let landlords evict tenants out into the street over this pandemic and over a problem tenants can not control. Like being laid off or having to wait on an unemployment check. Another thing landlords are landlords because they made that decision to supplement their income from the smaller guy and asking for extremely high rent. As a landlord you have to roll with the punches and stop crying about it. Again it was your decision to become one and you are not doing your tenants any big favors since they do pay when there is not a problem like there is now.

I wonder if renters have ever given the slightest thought as to what they could do to help their landlord save money so free or lesser rent could be afforded. It’s a novel idea, I’m sure for many tenants, but ask yourself what are or can you do to help out your Landlord, as a gesture of good will. There’s no law against tenants being generous or giving of something, is there?

As long as we remain this divided, we are going nowhere. This bickering is something else. This goes beyond party affiliation, greed, wealth vs poverty etc. What is happening is a gross lack of all of us actually listening. As long as we remain this divided, this negative, this angry, and verbally abusive, we are going nowhere. Just read the negative comments that I am almost certain will follow my post. Even though I said we / us to include myself. OK, here we go.

I don’t mind being divided! That keeps me away from liberals or FIBERALS as I like to refer to them. If you want to be around people who get along, then create a country which is ethnocentric. There are just too many people here from different cultures which they dragged in here, to have people get along at all. I’m surprised things are not worse than they already are.

Screw the landlords, bunch of greedy Trump wannabes. Scumbags of society. Making money not by working, but using hard working people to pay up. Housing should not be an investment but a place to live. If they want to “invest” , the stock market is there as are other business opportunities that are not usury in nature.
And screw the real estate people too, they don’t care as long as they get their cut, which is wayyyy too high…. anyone can buy or sell a house on their own. Increasing property prices are welcome by real estate people..

So if you are a landlord who owns multiple properties, go hang yourself because you are a thief. Same goes for real estate agents. You have chosen to do this, nobody forced you. Try getting a real job and see how it is.
