Stockton: 28-Year-Old Man Dies in Officer Involved Shooting After Driving at Officers

On June 14, 2015, at 5:31 pm, Stockton Police Officers observed a 28 year old Hispanic man inside a white vehicle attacking a 30 year old woman, who was later identified as the man’s girlfriend, in the area of Pershing Avenue and Rosemarie Lane.

As Officers went to contact the man to have him stop, the man drove away with the woman and led Officers on a pursuit down March Lane. The vehicle then went southbound up the off ramp of northbound Interstate 5 at which time Officers terminated the pursuit for safety reasons.

Officers located the vehicle driving in the area of Alpine Avenue and the pursuit continued. Officers were authorized and used legal intervention to make the vehicle stop. The man lost control of his vehicle and hit an unoccupied parked vehicle in the area of Delano Avenue and Calariva Drive.

At which point, Officers began to order the occupants out of the car with no cooperation.

As Officers approached the vehicle, the man accelerated the vehicle towards Officers. The vehicle struck one Officer in the arm and another Officer had to jump out of the way. The man then swerved the vehicle in the direction of an Officer.

Fearing for his life and others, the Officer and one other Officer fired their weapons at the man striking him multiple times. The man was transported to an area hospital where he died from his injuries.

Kenneth GarciaSuspect (Photo): Kenneth Garcia, a 28 year old Hispanic man, on Post Release Community Supervision for gun related charges. The suspect has prior arrests for felon in possession of a firearm and felony evading a peace officer. The man was documented as a possible gang associate out of Tracy. Officers also located what appeared to be suspected narcotics in the man’s pocket.

Suspect Vehicle: A 2007 white Chrysler, 4 door, stolen out of Tracy.

 

Involved Officers who discharged their firearms:

Stockton Police Officer Behnam Parsa, hired in 2012, assigned to the
Community Response Team.

Stockton Police Officer Jesse Smith, hired in 2013, assigned to the Community
Response Team.

The involved Officers were uninjured and placed on three day paid administrative leave.
