Pittsburg Man Sentenced to 80 Months In Prison For Possessing An Assault Rifle And Ammunition

OAKLAND –Cardelle Divon Peter was sentenced to 80 months in prison for possessing a firearm and ammunition after having been previously convicted of a felony, announced United States Attorney David L. Anderson and Federal Bureau of Investigation Special Agent in Charge John F. Bennett. The sentence was handed down today by the Honorable Jeffrey S. White, United States District Judge.

Peter, 23, of Pittsburg, Calif., pleaded guilty to the charge on January 8, 2019. According to his plea agreement, on January 6, 2018, Peter, a convicted felon, possessed a Smith and Wesson .223 caliber AR-15 style semi-automatic assault rifle with a 30-round high capacity magazine. The rifle was loaded with approximately seven rounds of ammunition. Peter also possessed a box containing an additional 62 rounds of ammunition for a separate firearm. According to court documents, law enforcement officers arrested Peter after someone placed a call to 911 and told the dispatcher that a person was threatening the occupants of a house with a rifle.

On September 13, 2018, a federal grand jury indicted Peter charging him with one count of being a felon in possession of a firearm and ammunition, in violation of 18 U.S.C. § 922(g)(1). Peter pleaded guilty to the charge.

In addition to the prison term, Judge White ordered Peter to serve a three-year term of supervised release to begin at the conclusion of his prison term. Peter has been in custody since his arrest and will begin serving his prison term immediately.

Special Assistant United States Attorney Samantha Schott is prosecuting the case with the assistance of Jessica Rodriguez Gonzalez. The prosecution is the result of an investigation by the Federal Bureau of Investigation and the Richmond Police Department.

A 30 round mag is standard capacity for the AR-15 armalite rifle not assult rifle. It is not a high capacity mag !!! The come from whatever factory that mfg it with a standard 30 round mag. Obviously this man was nit allowed to own this as he shouldnt. But im just stating the facts that the media and journalists perpetuate about these rifles to demonize them. Works like assult rifle and high capacity magazines are used to make them sound menacing !! Its a semi automatic rifle wich means you oull the trigger once and 1 round fires and another is loaded into the chamber. And a standard capacity magazine . Also unrelated but the .223 round is not a very large round its only slightly larger in diamater than a .22 cal ! Everyone says they are designed to kill when in actuality adopted by the US military because it doesent kill like a 308 its more likley to wound and incapacitate the enemy so he may be take in and interrogated for information. So it was actually adopted because its less likley to kill.

It shouldn’t matter if you’re a felon or not. The ones who carry them around legally are far more dangerous than us felons. I go shooting all the time and don’t cause any trouble to no one. Cops are shooting people every chance they get knowing that nothing will happen to them as far as punishment. No sympathy huh? Just for being a felon. Let me tell you something buddy. The only differences between felons and non-felons basically nothing. Just a word and stupid law they made to get more money out of us. Kind of ironic that they don’t want felons with guns and it’s always a non-felon who ends up commiting mass murder. If someone breaks into my house and their intent is to kill me and I shoot them in the leg and call the cops I go to jail for a long time. Someone does that to a non-felon and they shoot the intruder dead then they are cleared and considered a hero. Is that fair or is it still, “no sympathy”?

5 years for the felony gun crime and other charges 1.6 years is actually about right. The way it is headlined is what makes it sound crazy.

The difference between felons and non-felons is very clear. Felons were convicted of a felony, and the rest of us are law abiding citizens. If you don’t like the discrimination, you should’ve thought of that before you committed crimes. Especially felonies. I have no respect and no empathy for felons. You don’t deserve it. With the exception of bleeding hearts, society agrees with me. Deal with it, and think twice before you’re stupid enough to commit your next crime. The truth hurts.
