CASE Seizes Machine Gun with Grenade Launcher During Operation

Earlier this year, the CASE Team received a tip and launched an investigation into a person who allegedly obtained Glock conversion switches. When installed, these switches allow the pistol to fire in a full automatic mode. These switches are considered machine guns, which are illegal.

CASE later obtained a search warrant for the suspect and his residence. On Thursday, June 20, 2019, the CASE Team executed the search warrant at the suspect’s residence in Foster City.

CASE recovered the following from the residence:

  • Glock converter switches (4)
  • 5.56 caliber AR-15 style assault rifles (3)
  • 5.56 caliber machine gun with an attached silencer and grenade launcher
  • 9mm assault pistol (2)
  • 37mm incendiary rounds (2)
  • Large capacity magazines (23)

CASE arrested 41-year-old Joseph Holmes of Foster City without incident. He was arrested for possession of a machine gun, possession of an assault rifle, manufacturing an assault rifle, possession of a silencer, possession of a destructive device, illegal transfer of a firearm, importation of large capacity magazines and possession of an explosive agent. The investigation will be forwarded to the Contra Costa D.A.’s Office for prosecution.

CASE (Contra Costa County Anti-Violence Support Effort) is a joint effort by the Office of the Sheriff, California Department of Justice, California Highway Patrol, Bureau of Alcohol, Tobacco, Firearms and Explosives, Pittsburg Police Department, and Probation Officers from the Contra Costa County Probation Department. CASE was created in November 2011 as a collaborative effort to reduce violent crimes in Contra Costa, especially those related to illegal firearms.

Everyone should be able to own an assault rifle. I think it is great idea I also think maybe everyone who owns one go out in the woods and play war, and kill each other. There is zero reasons to have this kind of weapon in city limits. If you think you are gonna school me on weapons save your time I have been to more schooling for Armory classes and probably put more bullets down range than probably 95% of you Facebook hero’s

So obviously these weapons are way beyond any fine lines of legal firearms in California but technically speaking a 37mm launcher is considered a ‘flare launcher and in some instances it is legal to own one, it is not the same as an M203 40mm anti personnel grenade launcher typically attached to an M16 or M4 Carbine, the 37mm incendiary rounds are technically flares, which have legal purposes in specific applications in California, so they are pushing the shock value on that one, a really good lawyer stands a good chance of getting that charge mitigated. The full auto modifications are completely illegal in this state without a special license.
It’s almost impossible for a civilian to get real 40mm grenades unless he or she knows a military or black market arms dealer.
Nonetheless this guy is in a heap of trouble and it’s a good thing those weapons are off the street there is no practical sane reason why any civilian should have fully automatic weapons.

Also the pictures clearly show that the M4 style carbine with the flare launcher attached does not have a suppressor attached, it has a standard A2 muzzle break, the suppressor/silencer is on a different rifle.
Just saying the Sheriffs office should be more accurate with what they put out in a press release, it does make a difference, I guess grenade launcher sounds more scary, like they busted a terrorist or something.

They do make 37mm incendiary rounds and they are armor piercing used to burn and melt. Used the in Afghan to destroy vehicles after they were disabled

37mm versions are considered a Title 1 Firearm, and are not classified as “Destructive Devices” under the NFA. These launchers can be sold the same as regular firearms on an ATF Form 4473.[17]

There is no such thing as an Assault rifle or pistol. It’s a fabricated term used to scare people and further an anti gun agenda. “Assault” is an action, not a item.

Remember, the Bill of Rights, which was and is written for the people (not the Government) is clear when it comes to the Second Amendment. The Right to bear Arms Shall Not be Infringed is rather clear. There are no exceptions or exclusions. Specifically it is not up to any branch of the Government to define or decide which arms can or should be possessed. It is a Right, not a privilege.

If the citizenry ever has a need to rise up against a tyrannical Government there will be no exclusions when it comes to arms. Let’s hope that never happens, however make no mistake, it’s the sole reason 2A was written.
