Updated: Three Shot in Pittsburg Officer Involved Shooting, Suspect Identified

Just after 9:00pm Tuesday, Pittsburg Police officers were dispatched to the 1500 block of Kingsley Drive for a domestic disturbance call with a subject armed with a firearm.

The mother of the suspect called 9-1-1 stating that their 20-year-old son (later identified as Rigoberto Gutierrez) was acting irrational and was most likely under the influence of drugs.  The suspect was on the porch of the residence demanding entry into the residence.  Through a security screen door they could see he was armed with a firearm and had pointed it at his father several times.

Officers arrived on scene at immediately began to give verbal commands to the suspect, the suspect was uncooperative refusing to comply.  He was shot in the leg when he reached for his firearm, which was now in his waistband.  At least two of the rounds went through the security screen where the suspects father and 17-year-old brother were standing;  They were struck during the shooting (father in the stomach area and brother in the leg).

All three were transported to the hospital.  The father was treated and released, the 17-year-brother is in stable condition recovering from his injuries.

The suspect is expected to survive and will be transported to County Jail once he is released from the hospital for assault with a deadly weapon and additional weapons related charges.

The suspect’s handgun was recovered at the location.

As a part of the Contra Costa Officer Involved Shooting Protocol, this incident is being jointly investigated by Pittsburg Police Department and the Contra Costa District Attorney’s Office.  This is an active investigation and more information will be released as it becomes available.  The officer involved in this shooting has 20 years of experience in law enforcement.

9:15 am Update:

Just after 9:15 am Wednesday, the Pittsburg Police Department has identified the suspect as Rigoberto Gutierrez, 20. His booking photo is from a petty theft warrant arrest on February 15, 2016. He also has  He has prior arrests for drug possession, resisting an officer and petty theft.
